Legendary quarterback Peyton Manning, the NFL's only five-time Most Valuable Player and a 14-time Pro Bowl selection, has earned his place among the greatest quarterbacks in league history as the active leader in nearly every statistical passing category. Manning serves as a member of the American Red Cross National Celebrity Cabinet and The Pat Summit Foundation Advisory Board. He and his wife, Ashley, established the PeyBack Foundation in 1999 to promote the future success of disadvantaged youth by assisting programs that provide leadership and growth opportunities for children at risk. It has provided more than $10 million of impact to at-risk youth through its grants and programs since inception.

This session will be eligible for CE and/or CLE credit in various states.

Employers must be prepared to prevent and/or address a wide range of work place issues arising out of the internet and social media including workplace violence, bullying and claims from third parties who may be impacted by such issues. Employees are increasingly concerned about privacy; what is the impact of employers using social media, to screen potential workers or using technology to track employees’ whereabouts, whether they are working, and their health.

OSHA requires that employers provide a safe work environment. Employers must also take into consideration the ADA; NLRA; the Stored Communications Act and background check laws.

These competing considerations present challenges for employers in the cyber age where everyone is connected and the possibilities of bullying, violence, privacy concerns, and, other workplace concerns are increasing rapidly.

The panel will address policies and procedures employers can institute to mitigate some of those exposures.

  Business Interrupted: An Alien Concept?

First party business interruption coverage is traditionally the purview of property insurance, but is increasingly the focus of cyber-insurance products. The concepts may be alien to professional liability underwriters and brokers. This session will provide deep dive into business interruption coverage, including:

  • Understanding key business interruption coverage concepts (i.e., period of indemnity, extended period of indemnity, waiting period);
  • Dependent business interruption and contingent business interruption exposures and coverage;
  • Computer security failure, “systems failure” and other common coverage triggers; and,

This panel will explore those challenges through the mock trial of a legal malpractice claim involving estate planning with disgruntled family members.       D&O Trends: The Securities Class Action Explosion

    Shareholder securities class actions (SCAs) historically have been and continue to be the driver of the most significant losses in the public D&O liability insurance arena. One of the hottest D&O trends right now is the “explosion” in SCA litigation activity, driven by a number of factors: the migration of merger objection claims from state courts (especially Delaware Chancery) to the federal courts, in the form of SCA disclosure claims; a renewed focus on SCA claims against foreign-domiciled companies; and the emergence of a new group of plaintiff firms plying their trade in the SCA arena. This trend has left D&O insurers scrambling to reassess their D&O books and their assumptions regarding the exposures they face from SCA claims. This panel will discuss what lies behind these new dynamics

      Ransomware Attacks! A Survival Guide

      Trump Administration's Impact on Employment Law

    This session will be eligible for CE and/or CLE credit in various states.

    With President Trump vowing to repeal burdensome regulation, it is anticipated that the Trump Administration will significantly impact the employment practices landscape. At the Conference, we will be almost a year into the new administration. The panelists will discuss the changes implemented already by Executive Order (Fair Pay and Safe Workplaces Order revoked March 27th), as well as how key players in the administration, including the new Chair of the EEOC and the Secretary of Labor, are already implementing changes and re-shaping stated core missions for policies related to employment. The panel will explore how the laws/directions have changed, the impact of these changes on employment claims and best practices for risk mitigation in light of the evolving landscape.
