MPL / CYBER - What's HIPAA Got to Do With It? The recent case Hinchy v. Walgreen Co., etal., No. 49D06 11 08 CT029165 in Indiana resulted in a $1.44 Million plaintiff verdict in what was a landmark case involving protected health information (PHI) that a pharmacist took and shared with other people. Even though HIPAA does not allow for private causes of action when there is a data breach, in this case it allowed HIPAA to establish the standard of care in a professional liability negligence case. |

Cyber Crime continues to be a growing concern as Cyber Criminals find new ways to attack networks and steal information and/or transfer of money or assets. Banks, Corporation and Governmental Entities are increasingly at risk as are the assets they hold - in the form of money, securities and information. Worse yet - their insurance coverages may not be enough to protect them as Cyber Liability and Fidelity Bonds contain restrictions which could prohibit coverage under certain scenarios. CYBER - Meet the Regulators - Enforcement Activities Today This session will give attendees a peek behind the curtain into regulatory investigation of breaches, providing perspective on what happens when regulators investigate a breach of Protected Health Information (“PHI”) or Personally Identifiable Information (“PII”). Many breach notification laws require notification of regulators, and the regulatory notification generally triggers an investigation. Regulatory findings, particularly when fines and monitoring are required, may fuel plaintiffs’ class action litigation claims. This session is a “must attend” for those whose organizations keep sensitive data, as no organization is 100% protected from a breach of the sensitive information it holds. Learn what regulators expect, and steps that can be taken now and after a breach happens to minimize your organization’s exposure to regulatory fines and monitoring. |

CYBER - What is the "Best" Cyber Policy? This session will explore a growing dilemma in the world of products that address cyberliability exposures. The dilemma is that policies are very dissimilar, and nearly every carrier that has a policy (or an endorsement) indicates that their offering is “the best”. Since we can only truly know what’s best for a given insured in retrospect related to a specific claim, there is a lot of latitude in the potential for pairing insureds up with particular products when they are purchasing their policy. This session will establish ground rules for determining insureds’ needs and getting past carrier marketing materials to the real meat of whether or not a given carrier’s policy will be suitable, or possibly even optimal, for the insured. |

CYBER - The Dark Side of PCI: The Loss Adjudication Process This panel is going to discuss what happens from the standpoint of a merchant when there is a breach of credit or debit card information from a merchant’s computer system. The session will provide an overview of the Payment Card Industry (PCI) framework, the merchant’s responsibilities after a breach (or suspected breach), the costs and expenses that a merchant will be responsible for under the PCI framework, and the PCI process for determining fines and assessments against the merchant. |

Dale graduated from Arizona State University with a Bachelor of Science in Management in 1971. He has over 30 years experience in risk and quality management related positions. He has worked for an insurance company, as an insurance broker and as a regulator. Dale has been responsible for risk management and patient safety at two major national health systems, surviving three mergers along the way. He has been the chairman of the board of directors of a health insurance company and a vice chairman or member of the board of four other professional liability and health insurance companies. Dale has also developed and managed "off shore" captive insurance companies for healthcare systems.

Throughout his career he has been involved with organizations dedicated to improving patient safety. He was a member of the Hospital Risk Management Advisory Panel of the Joint Commission on Accreditation of Healthcare Organizations, a member of the American Healthcare System Council on Quality Assurance and Risk Management, a contributor to a Kellogg grant project to develop a Model Risk and Quality Management Program for healthcare organizations, and co-author of a trustee development program and Guidelines for Hospital Risk and Quality Management Board Reports. He is currently the Vice President of Business Health and Risk Management at Banner Health where he is responsible for insurance, management of their insurance subsidiary, claims administration and litigation management for self-insured professional liability and workers compensation, security, records management, HIPAA and occupational health. Liz Kim is Principal Underwriting Counsel for the US division of Hiscox, a leading Lloyd's of London syndicate and international specialist insurer. In that role, she acts as the chief legal advisor to the CUO, as well as to the Practice Leaders, Underwriting Leaders, and underwriting teams. She is responsible for wordings for all policies issued in the US, and for providing risk analysis on both the macro-level and for individual risks. She first joined Hiscox in their Claims Department and was the Head of Technology, Media, and Privacy Claims before taking on her current role. Prior to joining Hiscox, she practiced insurance coverage law for more than a decade, including being involved in some of the most significant insurance cases in the 9th Circuit at one of Chambers' highest-rated California insurance firms. Ms. Kim has advised both domestic and London insurance clients with respect to various GL, E&O, and specialty policies, and litigated coverage actions involving declaratory relief, contribution, rescission, reformation, and bad faith in state and federal courts throughout the United States. She has published several articles and served as a panelist on various topics relating to insurance law, technology and media litigation, and data privacy.
