The discussion will include the types of situations from which these claims typically emanate, how risk management can potentially mitigate or avoid these exposures, and underwriting and claims responses, such as batch clauses, inter-related claims provisions, etc. |

PRS: Fair Use in the Spotlight Our experts will review basic principles of copyright law, with particular emphasis on the important “fair use” carve-back to copyright infringement. They will explain how subtle and complex the fair use determination can be, and how reliance on copyright concepts, such as fair use “public domain” to use other people’s protected works, is often misplaced. The panel will discuss recent court decisions applying the fair use doctrine in different contexts, particularly as it relates to new technologies, websites and advertising. PRS: Settling for Escalating Defense Costs This panel will explore the various issues that are driving up defense costs for professional liability insurance claims, including E-discovery, the right to independent counsel, inflation and the hourly rates charged by attorneys. In-house counsel, outside counsel and an actuary will discuss the impact these factors have on the increase in defense costs and other costs associated with resolving professional liability insurance claims. Alice has been with CNA for about 30 years providing a variety of services to both underwriters and insureds. Current responsibilities include Risk Control Director for the National Allied Healthcare Facilities Practice. As such she participates in the development and provision of strategic appetite and underwriting direction. She collaborates with underwriters, actuaries, claims professionals, analytic staff and marketing to forecast, advise and support business development, risk identification and selection, rate adequacy, loss analysis, coverage enhancements and market opportunities. Alice has served as a hospital administrator and nursing home administrator and provided clinical care in surgery and emergency medicine. Alice developed and managed ECRI's inaugural national healthcare facilities risk management consultation service and subscription publication. A retired hospital administrator officer with the US Army Reserves, she received a Master of Science in Hospital and Health Administration from the University of Alabama at Birmingham. Professional designations include Charter Diplomat of the American Board of Risk Management, Distinguished Fellow of the American Society of Healthcare Risk Management and Fellow of the National Association of HealthCare Quality. She was named as one of 200 Women Leaders to Know in the ASC Industry by Becker’s Healthcare.

As a member of the Healthcare team in Aon Bermuda, Amy is responsible for a portfolio of healthcare risks placed into the Bermuda market. These risks include for profit and not for profit multi-hospital systems, university teaching hospitals, long term care, assisted living, medical malpractice, hospital physicians liability, managed care E&O, pharmacies and medical product manufacturers. Amy also places professional liability reinsurance with Bermudan reinsurers for physicians and hospital captives. <br/><br/>

Amy has 14 years experience in the insurance industry, working with middle market through Fortune 1000 clients. Prior to joining Aon in January 2010, Amy was a broker at Arthur J Gallagher in Bermuda for 5 years, working on professional liability, casualty, and property placements into the Bermuda marketplace. There she placed hospital professional liability for large hospital systems and long term care facilities on both an insurance and reinsurance basis. Ms. Wolfinger started her insurance career in Boston Massachusetts, working with both Liberty Mutual and St Paul Travelers insurance companies. Amy worked on a wide range of insurance products spanning large workers compensation loss sensitive programs to medical device errors and omissions coverage.

Dr. Esters is an Assistant Professor with South College School of Pharmacy. His primary practice area is Medication Safety at Methodist Medical Center in Oakridge, Tennessee. Dr. Esters received his Doctor of Pharmacy degree at Mercer University Southern School of Pharmacy in 2003. Prior to joining faculty at South College Dr. Esters was a Director of Pharmacy in the Knoxville, Tennessee market where he began a medication safety program. Dr. Esters is Certified Professional in Patient Safety. He is a member of Tennessee Pharmacist Association, Tennessee Society of Health-System Pharmacist, American Society of Health-System Pharmacy, Medication Safety Officer Society, and American Society of Patient Safety Professionals. Brad Ash currently serves as Senior Vice-President, Underwriting & Sales, for ISMIE Mutual Insurance Company & ISMIE Indemnity Insurance Company (collectively "ISMIE"). ISMIE provides physician MPL and other healthcare professional liability products and services on an admitted and excess & surplus lines basis. Prior to joining ISMIE, Mr. Ash had the privilege of serving many of the finest medical liability carriers in the industry including The Doctors Company, COPIC, The Medical Protective Company, & ProAssurance.
Mr. Ash received his Chartered Property Casualty Underwriter (CPCU) designation in 2005 and his Registered Professional Liability Underwriter (RPLU) designation in 2002. Deb began her career as a medical malpractice defense attorney representing hospitals and healthcare providers in Cook County, Illinois, and the surrounding area. Deb received her Bachelor of Arts degree from Washington University in St. Louis and holds a Juris Doctorate from the George Washington University School of Law and a Master's Degree in Public Health from the George Washington University School of Public Health. Dr. Gundersen is a graduate of the University of Texas Health Sciences Center in San Antonio, Texas where she received her Medical Degree in 1989. She completed residency training in Adult Psychiatry at the University of Colorado Health Sciences Center in Denver, Colorado in 1993. She is also board certified in Forensic Psychiatry. Dr. Gundersen is an Assistant Clinical Professor in the Department of Psychiatry at the University of Colorado where she teaches medical students, residents and fellows. She maintains a private practice specializing in general adult and forensic psychiatry. Gerry Lewis-Jenkins has been with COPIC since 1991 and held various positions before being named Executive Vice President in 2007. She oversees a number of department and business units essential to COPIC’s overall image including Underwriting and Policyholder Service, Sales, Corporate Marketing and Communications, Information Technology, and Public Affairs.
<br/><br/>
Ms. Lewis-Jenkins also oversees COPIC Financial Service Group, an independent insurance brokerage and consulting firm that is a wholly-owned subsidiary of COPIC. In addition, she is responsible for the business that COPIC writes in Nebraska and assesses new products, expansions, and possible acquisitions.

Before coming to COPIC, Ms. Lewis-Jenkins served as Executive Director of Humana Health Plans of Colorado. She also has a background as a registered nurse, with more than 15 years of experience in clinical and hospital management.

Ms. Lewis Jenkins was recently appointed to the American Hospital Association’s (AHA) Committee on Governance—a specialty committee to the AHA Board of Trustees that is responsible for providing input for policy development, leading involvement of hospital trustees in grassroots advocacy, providing advice on AHA’s trustee initiatives, and enhancing communication with and involvement of trustees.

Ms. Lewis-Jenkins is the immediate past chair of the board of directors for the Colorado Regional Health Information Organization, a nonprofit dedicated to improving health care for all Coloradans through health information exchange, and she serves on the board of the Platte Valley Medical Center, a community-owned, nonprofit hospital. She is also a Colorado Trustee Representative on the Western Regional Trustee Symposium Planning Committee.

Ms. Lewis-Jenkins recently became a Fellow of the Physicians Insurers Association of America and serves on the board of its Marketing Committee and Activities Committee. In addition, she is part of the Advisory Board for the Regis University Health Services Administration Graduate Program.

Previously, Ms. Lewis-Jenkins served on the Advisory Board of the Center for Bioethics and Humanities at the University of Colorado, and the boards of Think About It Colorado, a public awareness campaign focused on patient safety, and Shared Health, a subsidiary of Blue Cross/Blue Shield of Tennessee.

Greg is currently the chairperson of American Academy of Actuaries Medical Professional Liability Subcommittee. He also manages Deloitte’s Medical Professional Liability practice. His clients include insurance companies, risk retention groups, reinsurers, hospitals, captive insurance companies, and private equity firms both domestic and international. Mr. Chrin recently co-authored an article titled Transparency: Changing the World We Live In, for the Better (PIAA Inside Medical Liability Magazine, 3rd Quarter 2014)

Mr. Chrin’s unique role at Deloitte, which involves working for the insurance consumer, insurance department and the insurance/reinsurance industry, has given him a unique perspective on trends affecting all sides of the insurance purchasing decision. His diverse work experience has contributed to his appetite for research and development of training classes and presentations addressing key issues affecting insurance buyers and sellers. Greg specializes in M&A transactions, captive feasibility studies, and actuarial reserving and pricing studies. He recently returned from a medical tourism project overseas focused on recommending an MPL insurance structure to benefit patients, providers, doctors, insurers, and the public.

Hoppy Stauffer (PANELIST)

In 1986, Hoppy Stauffer began managing physician offices. This included OB/GYN, Anesthesiology, Pain Management and Chiropractic. She continued this for approximately 10 years. In 1996, Ms. Stauffer began working for Zurich-American Insurance in their Agency Accounting Department handling approximately 400 plus agents. From there, she moved over to underwriting in a support staff role in Excess Casualty and then, when the Healthcare Department opened up, moved back into the Healthcare venue. Ms. Stauffer became an Associate Underwriter and thoroughly enjoyed this aspect of the industry. In the spring of 2000, the Zurich Healthcare Department closed on the West Coast, so Ms. Stauffer went over to the Wholesale side, staying in the Healthcare niche. Other than a brief 5 month stint at Aon as the Southwest Relationship Manager for Healthcare, she has been on the Wholesale side ever since. Ms. Stauffer currently works at Worldwide Facilities in the position of National Practice Leader for Healthcare and loves every minute of it. Over the years, she has had some excellent mentors which include Fran O’Connell, whom Ms. Stauffer worked with at Zurich during her brief break from Markel.

Jonathan S. Ziss is a partner in Goldberg Segalla’s Philadelphia office. He chairs the firm’s Professional Liability Practice Group, a team of more than 50 lawyers encompassing a wealth of experience handling all manner of professional liability claims and cases.

In addition, Jonathan is frequently called upon to represent accountants in investigations by federal, state, and local authorities, including the Internal Revenue Service, the FBI, and the Department of Labor, as well as investigations by bankruptcy trustees and creditors’ committees. He has worked with accounting firms preparing for grand jury appearances. Outside of the E&O arena, Jonathan has counseled and represented accountants, architects, attorneys, wealth insurance agents/brokers, physicians, TPAs, and wealth managers on matters relating to covenants not to compete, employment liability, and other business and internal matters.

Jonathan is a past chair of the PLUS Mid-Atlantic Steering Committee. She provides consultative services to improve and enhance risk management and patient safety programs. An emphasis is placed on risk reduction techniques and innovative approaches to improve patient safety and reduce preventable harm.

The experience that Ms. Shostek brings is extensive. This includes risk management leadership at the acute care level and corporate multispecialty physician group practice. As a TeamSTEPPS master trainer, Kathy works with healthcare organization leaders to engage providers and staff in learning to use communication and teamwork strategies that improve working relationships, enhance patient safety, and reduce the risk of error. She is the author of content for ECRI’s Healthcare Risk Control System and had articles published in journals such as the Journal of Healthcare Risk Management, Health Executive, and Patient Safety & Quality Healthcare, and she has been quoted in Bests Review and Risk & Insurance; she co-authored a chapter with Peter Pronovost, MD in ASRHM’s Risk Management Handbook for Healthcare Organizations, 5th edition.

Kathy received a degree in Business Administration from Wilkes University and is a graduate student in the MBA-Health Systems Management program at DeSales University, Center Valley, PA. Scott Crockett represents insurers and healthcare providers with respect to healthcare and medical malpractice litigation exposures. Scott evaluates, manages and negotiates high exposure litigation on behalf of clients and assists clients in claim evaluation, policy drafting, coverage disputes, and auditing.

Scott received his BA from Washburn University and his law degree from the University of Kansas. In private practice Scott represented hospitals and physicians in medical negligence cases. In 1987 he became in-house counsel to Employers Reinsurance Corporation (ERC) where he enjoyed a 15 year career. Scott was Vice President in charge of all medical malpractice claims matters and supervised a staff of over 100 attorneys and adjusters. He has personally mediated or negotiated hundreds of catastrophic injury medical malpractice cases.

Valoree J. Celona, President of Allied Health and Programs for Coverys Group, has over 30 years of casualty & professional liability underwriting experience. Valoree received her B. A. in Economics from Fordham University and earned her CPCU designation early in her career. Valoree began her career in insurance as an underwriting trainee in Medical Professional Liability (MPL) at Medical Liability Mutual Insurance Company (MLMIC). After her promotion to underwriter, Valoree joined AIG Healthcare where she underwrote various classes of Commercial MPL. Valoree was then asked to join the LPL division of CNA with former colleagues who had left AIG. At CNA she underwrote LPL across CNA’s large nationwide platform. After some time, Valoree returned to AIG Healthcare working as senior underwriter and then assistant regional manager for the NY Region. In the early 2000’s along with some colleagues from AIG, Valoree joined the facultative team at Employers Reinsurance where she underwrote D&O, E&O exclusively. Valoree remained in the reinsurance world working at both Odyssey Re and Converium Re as both Facultative and Treaty underwriter. In 2005, Valoree was recruited to join Ernst and Young’s Business Risk Consulting group, focusing on best practice reviews and anti-money laundering within the Financial Services Industry. There she became a Certified Anti-Money Laundering Specialist (CAMS) and worked on some of the largest financial crime remediation projects in the USA. When the financial crisis hit in September 2008, Valoree was recruited back to AIG Healthcare and held positions of increasing responsibility for programs in both the US & Canada. After 5 years, Valoree was approached by a former AIG colleague and hired as division executive and Senior Vice President for the MPL initiative at LIU. Valoree held the role of Senior Vice President over programs and physicians following the merger of Liberty International Underwriters (LIU) and Ironshore. After 5 successful years, Valoree recently joined Coverys as President of Coverys Programs and Allied Health. In this role she is focused on strategically expanding and diversifying the Coverys corporate footprint within the professional liability arena and overseeing the allied health portfolio.
