This session will discuss some of the past predictions made about how ACA was going to impact medical professional liability and share some of the most recent data on what is actually happening. We will explore how this is impacting medical malpractice trends from a variety of perspectives with insurance and healthcare experts.
  PRS: How IS the EPL Landscape Changing?
Just as seasons change, so do the landscapes you see outside your front window, and the same can be said for employment law. There are many changes to discuss and some are happening very quickly. Participants will listen to this panel discuss (and debate) current trends in employment practices liability, including some of the latest developments and evolving exposures impacting EPLI insureds today. The panel will also discuss venue’s impact on exposures, and what carriers are doing to address these changes in the employment practices arena.

In a time where Health Care Technology is developing at lightning speed, this session will focus on concerns for insurance risk management professionals that include evolving exposures, coverage concerns and potential claims development. The panel will discuss the myriad of technological advances being put forward, heightened exposures due to increasing collection of PHI, and the impact on risk management and underwriting approaches being utilized. Attendees will hear from experts that specialize in underwriting, the technological aspects, and risk analysis and risk mitigation, who will share best practices and new strategies for underwriters and risk managers.
  PRS: Navigating Prior & Pending and Other Coverage Issues
This panel of insurance experts will provide an update on the increasing use of the prior and pending exclusion in management and professional liability policies, and other related coverage issues such as prior notice and interrelated wrongful acts. The panel will provide attendees with a sophisticated discussion from the different perspectives of an underwriter, claims-counsel, broker, and coverage counsel

  MedPL: Batch Claims: what ARE the "Three P's"?
This panel will address the potential for “cat” or batch/multi-claimant situations in the context of medical professional liability claims, and how it has developed over the years. The discussion will include the types of situations from which these claims typically emanate, how risk management can potentially mitigate or avoid these exposures, and underwriting and claims responses, such as batch clauses, inter-related claims provisions, etc.
  PRS: Fair Use in the Spotlight
Our experts will review basic principles of copyright law, with particular emphasis on the important “fair use” carve-back to copyright infringement. They will explain how subtle and complex the fair use determination can be, and how reliance on copyright concepts, such as fair use “public domain” to use other people’s protected works, is often misplaced. The panel will discuss recent court decisions applying the fair use doctrine in different contexts, particularly as it relates to new technologies, websites and advertising. Participants will learn to identify copyright exposures facing professional firms and other standard commercial businesses.

  MedPL: The Changing & Expanding Role of Emergency Medicine
Our panel will discuss the evolving role of Emergency Departments across the country, particularly in light of ACA. How are EDs changing and expanding their role to meet the needs of expanding patient load, as even more primary care is shifted to EDs?
  PRS: Settling for Escalating Defense Costs
This panel will explore the various issues that are driving up defense costs for professional liability insurance claims, including E-discovery, the right to independent counsel, inflation and the hourly rates charged by attorneys. In-house counsel, outside counsel and an actuary will discuss the impact these factors have on the increase in defense costs and other costs associated with resolving professional liability insurance claims. The panel will also focus on how rising defense costs are trending and will show how predictive modeling can facilitate reasonable settlements and help control defense costs.

This session will explore a number of the most challenging components within this highly talked about topic. We will hear from the industry on how the malpractice carriers underwrite and price these exposures; and on the clinical side- where will this lead for prescriptions? How do the claims aspects differ from the more traditional practice of medicine, and how does it affect exposures in states that currently do not allow for medical marijuana? Finally, how do the related social issues play into this, if at all?
  PRS: The Wild, Wild Future: Privacy & Data Security Exposures
Cyber liability/Privacy are the HOT topics right now. This panel will update you on the latest developments in the coverages available and the current state of the market. Experts in the field from the underwriting, claims, brokers/agents, legal and consulting disciplines will discuss the state of technology/risk management, evolving regulations, enforcement developments, and litigation, as it impacts the PL/E&O coverages being offered.

These new business and provider models are becoming popular with consumers and health plans alike. One stop shopping makes services accessible for the time-challenged, while the low cost of primary care in retail medical clinics is attractive for employers seeking value in health insurance contracts. The panel of insurance and healthcare professionals will discuss strategies to mitigate risk exposures and plan for the medical liability claims that may evolve with the increased volume of individuals purchasing health insurance coverage under PPACA.

Listen to this panel of experts discuss the “crime” exposures of today - virtual currency/bitcoin, phishing, social engineering, false vendor payment fraud and how carriers are responding. Renew your understanding of the basic tenants of crime coverage: discovery v. loss sustained, computer crime and funds transfer fraud, employee dishonesty or theft of clients property? Make sure you know the exposures, how carriers are underwriting, coverages available, and what agents and insureds should consider in the purchasing decision.

Few would disagree that a higher E&O insurance limit -at least in some instances - increases a claim’s settlement value. One can reasonably ask: how much professional liability insurance is “enough”? With an extremely high-value loss, can a practitioner or entity actually be over-insured? Conversely, can a case be made for “less is more”- the lower the limit, the lower the exposure? A lively debate is guaranteed with our expert panel, which includes a broker, underwriter claims professional, and an esteemed plaintiffs’ attorney. As Personal Health Information continues to plague healthcare providers, can these exposures also impact medical professional liability exposures?
