The panel will also address how to advise policyholders on what limits to carry and will focus on a wide range of professional liability disciplines.
4:00 pm - 5:15 pm
MPL - Tackling the Top Claims Trends
From TeleHealth to the ever maturing claims professional, what, how and where are we going in the Medical Professional Liability Claims arena? Are we prepared to allow less seasoned defense attorney’s try our cases? If we don’t who will try them in the next 5 to 10 years? What about claims talent? As baby boomers retire, can we shape the new generation of professional liability claims professionals soon enough? Physicians text, Skype and provide virtual consults from their desktop to patients sometimes hundreds of miles away. Are we prepared to defend their virtual practice claims? How are we doing in severity and frequency? Interest rates are low. The costs of long term care for our birth injury plaintiff is high, are we paying more for resolutions? How are we doing with rebutting plaintiff strategies like the “reptile approach?” What will our insurance base be like under healthcare reform? Will physicians be scooped into hospital programs and where does that leave many a carrier claims professional? Hear from five industry claims leaders on current claim trends and what to expect in the coming years as we roundtable and put it all together for you at PLUS MPL.
PRS - How Professional Services Agreements Impact Professional Liability Exposures
Design Professionals have always had to deal with contract language that potentially jeopardizes their insurance coverage. This panel will discuss historical problems and then focus on more recent trends in contract language, including problematical demands for defense and indemnification. They will explore what drives design and other professionals' contract requirements and the impact those requests have on the professionals' liability exposures, and also talk about creative risk management and coverage responses to address those exposures.

PRS - What IS Your Role in PLI Claims or Litigation?
This session will examine the roles of carriers, brokers, and defense counsel in the claims handling and litigation process. Attendees will hear from industry professionals about their common and competing views on their responsibilities and about strategies to achieve their objectives.

MPL / CYBER - What's HIPAA Got to Do With It?
The recent case Hinchy v. Walgreen Co., etal., No. 49D06 11 08 CT029165 in Indiana resulted in a $1.44 Million plaintiff verdict in what was a landmark case involving protected health information (PHI) that a pharmacist took and shared with other people. Even though HIPAA does not allow for private causes of action when there is a data breach, in this case it allowed HIPAA to establish the standard of care in a professional liability negligence case.
PRS / CYBER - Does My Client Need Professional AND Cyber Liability?
There is a proliferation of new cyber forms, yet many producers working in professional liability are hesitant to address possible privacy & data security or tech E&O risks, and average buyers are not savvy about those exposures or understand that coverage, when provided as an “add-on” to their PLI policy, may be inadequate.
2:30 pm - 3:45 pm
MPL / CYBER - Privacy & Data Security Risk Management for Health Care Professionals
In an ever expanding digital age, this session will focus on risk management for health care providers regarding privacy and data security exposures. The panel will navigate the HITECH “Omnibus Final Rule” and how it impacts the HIPAA Privacy Rule, HIPAA Breach Notification Rule and Enforcement Rule. Attendees will hear from experts that specialize in risk analysis and risk mitigation; these experts will share best practices and keys for successful compliance.
PRS / CYBER - Cyber Crime - Crime of the 21st Century?
Cyber Crime continues to be a growing concern as Cyber Criminals find new ways to attack networks and steal information and/or transfer of money or assets. Banks, Corporation and Governmental Entities are increasingly at risk as are the assets they hold - in the form of money, securities and information. Worse yet - their insurance coverages may not be enough to protect them as Cyber Liability and Fidelity Bonds contain restrictions which could prohibit coverage under certain scenarios. The panel will discuss the most common types of Cyber Crime activities and where there may be potential overlap or gaps in coverage as respects these two types of policies.
4:00 pm - 5:15 pm
CYBER - Meet the Regulators - Enforcement Activities Today
This session will give attendees a peek behind the curtain into regulatory investigation of breaches, providing perspective on what happens when regulators investigate a breach of Protected Health Information (“PHI”) or Personally Identifiable Information (“PII”). Many breach notification laws require notification of regulators, and the regulatory notification generally triggers an investigation. Regulatory findings, particularly when fines and monitoring are required, may fuel plaintiffs’ class action litigation claims. This session is a “must attend” for those whose organizations keep sensitive data, as no organization is 100% protected from a breach of the sensitive information it holds. Learn what regulators expect, and steps that can be taken now and after a breach happens to minimize your organization’s exposure to regulatory fines and monitoring.

CYBER - What is the "Best" Cyber Policy?
This session will explore a growing dilemma in the world of products that address cyberliability exposures. The dilemma is that policies are very dissimilar, and nearly every carrier that has a policy (or an endorsement) indicates that their offering is “the best”. Since we can only truly know what’s best for a given insured in retrospect related to a specific claim, there is a lot of latitude in the potential for pairing insureds up with particular products when they are purchasing their policy. This session will establish ground rules for determining insureds’ needs and getting past carrier marketing materials to the real meat of whether or not a given carrier’s policy will be suitable, or possibly even optimal, for the insured.
10:00 am - 11:15 am
CYBER - The Dark Side of PCI: The Loss Adjudication Process
This panel is going to discuss what happens from the standpoint of a merchant when there is a breach of credit or debit card information from a merchant’s computer system. The session will provide an overview of the Payment Card Industry (PCI) framework, the merchant’s responsibilities after a breach (or suspected breach), the costs and expenses that a merchant will be responsible for under the PCI framework, and the PCI process for determining fines and assessments against the merchant.
