MPL / CYBER - What's HIPAA Got to Do With It? The recent case Hinchy v. Walgreen Co., etal., No. 49D06 11 08 CT029165 in Indiana resulted in a $1.44 Million plaintiff verdict in what was a landmark case involving protected health information (PHI) that a pharmacist took and shared with other people. Even though HIPAA does not allow for private causes of action when there is a data breach, in this case it allowed HIPAA to establish the standard of care in a professional liability negligence case. |

Cyber Crime continues to be a growing concern as Cyber Criminals find new ways to attack networks and steal information and/or transfer of money or assets. Banks, Corporation and Governmental Entities are increasingly at risk as are the assets they hold - in the form of money, securities and information. Worse yet - their insurance coverages may not be enough to protect them as Cyber Liability and Fidelity Bonds contain restrictions which could prohibit coverage under certain scenarios. The panel will discuss the most common types of Cyber Crime activities and where there may be potential overlap or gaps in coverage as respects these two types of policies. |

CYBER - Meet the Regulators - Enforcement Activities Today This session will give attendees a peek behind the curtain into regulatory investigation of breaches, providing perspective on what happens when regulators investigate a breach of Protected Health Information (“PHI”) or Personally Identifiable Information (“PII”). Many breach notification laws require notification of regulators, and the regulatory notification generally triggers an investigation. Regulatory findings, particularly when fines and monitoring are required, may fuel plaintiffs’ class action litigation claims. This session is a “must attend” for those whose organizations keep sensitive data, as no organization is 100% protected from a breach of the sensitive information it holds. Learn what regulators expect, and steps that can be taken now and after a breach happens to minimize your organization’s exposure to regulatory fines and monitoring. |

CYBER - What is the "Best" Cyber Policy? This session will explore a growing dilemma in the world of products that address cyberliability exposures. The dilemma is that policies are very dissimilar, and nearly every carrier that has a policy (or an endorsement) indicates that their offering is “the best”. Since we can only truly know what’s best for a given insured in retrospect related to a specific claim, there is a lot of latitude in the potential for pairing insureds up with particular products when they are purchasing their policy. This session will establish ground rules for determining insureds’ needs and getting past carrier marketing materials to the real meat of whether or not a given carrier’s policy will be suitable, or possibly even optimal, for the insured. |

CYBER - The Dark Side of PCI: The Loss Adjudication Process This panel is going to discuss what happens from the standpoint of a merchant when there is a breach of credit or debit card information from a merchant’s computer system. The session will provide an overview of the Payment Card Industry (PCI) framework, the merchant’s responsibilities after a breach (or suspected breach), the costs and expenses that a merchant will be responsible for under the PCI framework, and the PCI process for determining fines and assessments against the merchant. |

<strong>PROFESSIONAL EXPERIENCE</strong><br/>
Based in New York and Connecticut, Steve provides Fidelity Bond expertise to offices throughout the U.S. responding to complex coverage and claim issues surrounding Financial Institution Bond and Commercial Crime policies. He has more than 30 years of experience.<br/><br/>
Steve is also responsible for the broking and servicing of Fortune 500 companies and Financial Institution Bond placements within the practice. Broking responsibilities also include ancillary bond products, such as Excess SIPC and All Risk Form J policies.<br/><br/>
Prior to joining Willis Towers Watson, Steve worked with two global brokerage firms handling Fidelity Bond placements for money centre institutions, stockbrokerage firms, insurance companies and Fortune 500 companies. He began his career with an insurance carrier underwriting Fidelity and Surety Bond accounts.<br/><br/>
<strong>CREDENTIALS</strong><br/>
Steve has spoken at numerous conferences on the subject of Financial Institution Bonds and Comprehensive Crime Policies, including the American Bankers Association, RIMS, PLUS and the American Bar Association. Steve graduated from the State of University of New York at Oswego with a BA. He has completed numerous accounting and business law postgraduate courses.

Steve joined Beazley as a specialty lines underwriter for Beazley Architects and Engineers in January 2006. Before joining Beazley, he was the Senior Underwriter for Lexington Insurance Company specializing in large firm underwriting. Prior to that, he was an underwriter at XL Design Professional. Steve is based in Philadelphia. He obtained his RPLU designation in 2008 and his MBA in 2010.

Suzanne Delio (PANELIST)

Suzanne C. Delio currently heads the E&O team at Freedom Specialty and is also co-manager of the employment practices team. Prior to working at Freedom Specialty, Suzanne litigated at a Manhattan firm handling construction litigation, labor law, and civil rights cases. She has of Bachelor of Arts in history and media and communications from Fordham University and her Juris Doctor degree from St. John’s University. Suzanne has been an adjunct professor at Fordham University since 2007 teaching courses in media law and journalism and the law.

Tammy Kocher, Senior Technical Specialist and Underwriter, joined Argo Pro in 2011. She helped develop Argo information and Professional Risk PlaybookSM product and she has played a pivotal role in the training and development of the underwriting team. Tammy is passionate about educating brokers and prospective customers on coverages and exposures in their Professional Lines E&O, as well as Cyber Security insurance. She is a Subject Matter Expert, mentoring her peers on the Argo Pro Team and a consistent contributor in both Argo Pro Product offerings and Agency Relationship Management. She brings over 17 years of insurance experience to this role. She was formerly a Senior Underwriter at Chubb insurance specializing in Miscellaneous Professional, Technology, Media, Cyber Security, and Management Liability. Prior to that, she was an Underwriter for Monitor Liability underwriting Publicly Traded Companies. Throughout her career, she has taught Continuing Education courses and seminars, on Miscellaneous Professional Liability and Cyber Security. She earned a Bachelor in Business, from Illinois State, where she played Division I Basketball. Tammy received her MBA, with honors, from Keller Graduate School of Management.

Mr. McInnis is a partner in the Orange County, CA office of Troutman Sanders LLP where he represents insurance companies in coverage and bad faith litigation involving a broad range of insurance lines, including primary and excess D&O, EPL, E&O, cyber, media/tech, product recall, general liability, and pollution policies. He also provides pre-litigation counseling and advice to insurance clients regarding complex coverage and claims-handling issues, and advises insurers on policy drafting. He is a past chair of the ABA/TIPS Professionals’, Officers’ and Directors’ Liability Committee, and currently serves on the Editorial Board of IRMI’s CGL Reporter. He received his law degree in 1991 from Columbia University, and has focused his practice on insurance law for the past 21 years.
