PRS: Fair Use in the Spotlight Our experts will review basic principles of copyright law, with particular emphasis on the important “fair use” carve-back to copyright infringement. They will explain how subtle and complex the fair use determination can be, and how reliance on copyright concepts, such as fair use “public domain” to use other people’s protected works, is often misplaced. The panel will discuss recent court decisions applying the fair use doctrine in different contexts, particularly as it relates to new technologies, websites and advertising. Participants will learn to identify copyright exposures facing professional firms and other standard commercial businesses. |

This panel will address the potential for “cat” or batch/multi-claimant situations in the context of medical professional liability claims, and how it has developed over the years. The discussion will include the types of situations from which these claims typically emanate, how risk management can potentially mitigate or avoid these exposures, and underwriting and claims responses, such as batch clauses, inter-related claims provisions, etc. |

The panel will also focus on how rising defense costs are trending and will show how predictive modeling can facilitate reasonable settlements and help control defense costs. |

Chad E. Milton has enjoyed a long and distinguished career in all areas of insurance and risk management for media companies, and is now a partner and founder of Media Risk Consultants. Most recently, he was a founder and partner in ThinkRisk Underwriting Agency, a general managing underwriter responsible for both underwriting and claim management of media liability insurance policies. Before creating ThinkRisk, he was Senior Vice President of Marsh, and National Practice Leader for Media and Intellectual Property, where he was a resource to Marsh offices and clients on these issues. While at Marsh, he was twice named Power Broker for Media –Entertainment by Risk & Insurance Magazine. Prior to this appointment in 2000, he was Senior Vice President, Claims and Marketing of Media/Professional Insurance, the nation’s largest underwriter of media insurance. For more than 20 years, he was responsible for managing libel, privacy and intellectual property litigation against all types of media, including being responsible for claims connected to Media/Professional’s office in London. He began his media insurance career at Employers Reinsurance, joining Media/Professional in 1981. Among other activities, he has been a founder and member of the executive board of the Libel Defense Resource Center in New York, chair of the Intellectual Property Law Committee of American Bar Association’s section on Torts, Trial and Insurance Practice, and on the editorial board of the E-Commerce Law Reporter. In addition, he has been a frequent consultant to media companies and associations on loss prevention and risk management. Before beginning his career in law and media insurance, he worked as a reporter, photographer and editor for a daily newspaper in Colorado. He is educated at Colorado College (Phi Beta Kappa), University of Missouri Graduate School of Journalism, and the University of Colorado School of Law. He is named in Who’s Who in American Law, Who’s Who in America and Who’s Who in the World.

Nashville native Charley Hine has built internet products for over half his life. His first job was in the technology department for the City of Brentwood, TN during high school. For a decade he worked on digital content distribution platforms (music, games, books), and was involved in several company buy-outs. Before starting Chain.com, he headed up product development at Ticketfly (the leading competitor to Ticketmaster). In May 2014 he started building Chain.com with a team of like-minded Bitcoin aficionados. Chain.com allows developers and enterprise to more easily connect, build and scale bitcoin block chain data. Chain.com has raised over $13 million in venture capital funding. Charley has his BS in Information Systems from University of Colorado, Boulder, and resides in San Francisco, CA.

Jeff handles employment claims for public, private and non-profit sectors. He joined Beazley from a large domestic insurer where he handled Directors & Officers, Employment Practices Liability, Fiduciary and Miscellaneous Errors & Omission Claims in the private and non-profit sectors. Prior to coming in-house, Jeff practiced insurance coverage law for a medium sized Washington, DC based law firm. Leib Dodell is an attorney and insurance executive with extensive experience underwriting and managing insurance coverages for media, technology, cyber and intellectual property-related risks. Leib currently serves as a consultant to the industry, helping businesses draft marketing materials and policy wording, implement underwriting guidelines, review and monitor claims, etc. He joined ANV, a Barcelona-based specialty insurance group, in January 2014 to launch a specialty Managing General Agency (MGAs) focusing on media and cyber coverages for the Main Street commercial marketplace. From 2009 to 2011, Leib was co-founder and Chief Executive Officer of ThinkRisk Underwriting Agency, a start-up MGA based in Kansas City, Missouri. From 2004 to 2009, Leib was President and Chief Executive Officer of AXIS Pro (formerly Media/ Professional Insurance), one of the largest underwriters of media, technology and miscellaneous professional liability in the world. Leib also founded the media liability program at Executive Risk (later acquired by Chubb), and later managed all E&O business for Chubb's Western Zone.
<br/><br/>
Prior to entering the insurance industry, Leib was an experienced attorney specializing in First Amendment and intellectual property litigation. Mr. Dodell practiced at the Washington, D.C. law firm of Williams & Connolly, where he represented many of its media clients, including The Washington Post and the National Enquirer. Mr. Dodell earned his J.D. <em>summa cum laude</em> from George Washington University National Law Center and his B.A. <em>cum laude</em> from the University of Maryland at College Park. Leib is currently a member of the Board of Trustees of the Professional Liability Underwriting Society (PLUS). In his free time, Leib is an avid swimmer, cyclist and triathlete, and enjoys romping with his two dogs, Bear and Benji. Prior to this role, Rob was leader of Bond’s Program unit focusing on specialty D&O. In 2005, Rob was named Bond’s D&O and Management Liability Product Manager for privately held corporations including strategic pursuit of General Partnership Liability. In 2003, Rob led of team of dedicated underwriters pursuing Side A/Broad Form D&O coverage for publicly traded corporations. In 1997, Rob led Travelers Bond’s creation of their EPLI product and was named EPLI Portfolio Manager shortly thereafter. While at a predecessor company, Rob specialized in underwriting ERISA Fiduciary Liability, fidelity bonds and excess SIPC products for financial institutions and large commercial entities. Scott Schmookler is a partner in the firm's Chicago office. Mr. Schmookler's practice focuses on insurance coverage, cyber security and commercial litigation. <br/><br/>
Mr. Schmookler frequently is retained to represent insurers in complex coverage disputes across the country. He has extensive experience representing insurers in coverage disputes, particularly in the areas of fidelity bonds, directors and officers insurance, and professional liability insurance. He regularly represents domestic and international insurers in coverage evaluation and litigation, has drafted policy language for different types of policies, and has developed different types of policies for a major insurer.<br/><br/>
Mr. Schmookler regularly counsels clients on insurance issues relating to technology, cyber crime, cyber security, and data breaches. Representing insurers in claims under commercial crime policies, computer crime policies, cyber security policies, and data breach insurance policies, he provides advice of insurance claims arising from data breaches and cyber attacks, coordinates remediation and regulatory responses, and litigates coverage disputes. Mr. Schmookler has been active in working with insurers in the development of new insurance programs and manuscripted coverages relating to cyber security and data breaches.<br/><br/>
Mr. Schmookler also has extensive commercial litigation experience as he counsels corporate and individual clients. His experience includes the successful resolution of breach of contract and breach of fiduciary duty cases, defense of actions against condominium and real estate developers, and the misappropriation of trade secrets. He counsels corporate clients and financial institutions on UCC issues involving negotiable instruments and banking related matters. He has represented clients in various types of banking disputes, and has extensive experience with Artlcle 3 and 4 of the Uniform Commercial Code. <br/><br/>
Mr. Schmookler is an active member of the American Bar Association, the Fidelity Law Association and the Surety Claims Institute. He is a frequent lecturer and scholar in the area of insurance coverage, cyber security and data breaches, fidelity and surety. <br/><br/>
