  Managing the Risk of Long Arm U.S. Enforcement
Aggressive enforcement action by US agencies, both civil and criminal, is an ever-present threat for international companies. David Bermingham, one of the "NatWest Three," will discuss the practical consequences of being ensnared in a major corporate criminal investigation, including extradition and the difficulties of contesting a criminal action as an individual. Drawing on personal experience and other recent case studies, he will highlight the modus operandi of the US enforcement agencies, the pressure on companies to enter into deferred prosecution agreements, and the potential for individuals to be ‘thrown under the bus’ for the greater good of the company.
