Spark Session: The Second Wave of the Opioid Epidemic
The Beach Boys sang "catch a wave and you are sitting on top of the world". The Beach Boys did not know how deadly a wave could be. The next wave of the opioid epidemic is going to kill more people than the first wave did. Spark Session: A Bird's Eye View of Potential Drone Risks and Insurance Issues
Unmanned Aerial Vehicles ("UAVs" or "drones") are becoming more commonplace in the commercial sector. Although their use has been largely limited to the military or recreational arenas, a variety of industries are increasingly relying on drones to more quickly and effectively perform myriad functions. For instance, project engineers now use UAVs to survey construction sites; farmers use them to inspect crop progress; companies like Amazon use them to deliver products to your doorstep; and communication and utility companies use them to inspect cell towers and electrical lines. With this increased use comes increased risks, ranging from liability for bodily injury or property damage, privacy violations and other personal injuries, and contribution to professional negligence. This session will seek to spark discussion about: the various uses of and regulations governing UA Vs; potential risks for companies wishing to utilize drones in various capacities; potential underwriting issues insurance companies may want to consider when issuing policies to insureds who use UAVs in the scope of the work for which they are seeking coverage; and potential coverage issues from a claims perspective. |

Carol Zacharias is underwriting counsel to QBE North America, a multinational insurer providing property, casualty, crop and specialty insurance including directors' and officers', employment, professional liability, and errors and omissions insurance. Prior to joining QBE, Carol was Deputy General Counsel to Ace North America, now part of the Chubb Group of Insurance Companies. <br/><br/>
Ms. Zacharias attended New York University School of Law where she received a master's degree in corporate law. She has served as Chairman of the American Bar Association Business Law Section's Business Insurance Committee and Vice Chairman of the Professional, Officers' and Directors' Liability Law Committee of the Tort and Insurance Practice Section. Claudia A. Costa is a partner in the New York office of Gordon & Rees and a member of the Employment Law, Professional Liability Defense and Commercial Litigation practice groups. Ed Talarico
After spending 26 years on the insurance carrier side, Ed Talarico joined ARC Excess & Surplus, LLC. on January 1, 2020. In this new role, Ed will be working closely with Chris Cavallaro, founder of ARC, and his team of talented brokers in ARC’s headquarters, located in Jericho, NY where he will specialize in placing all lines of professional liability insurance.
Prior to joining ARC, Ed Talarico was SVP of Management Liability at RSUI, based in Atlanta, GA from June 2016 to May 2019. He was responsible for the overall management of a team of underwriters who offered primary and excess products to publicly-traded, privately-held, not-for-profit and public officials/public entities exclusively from appointed wholesale brokers.
Before this role, Ed had overall management responsibility for AXIS Commercial Management Solutions, which consists of four regional underwriting teams throughout the U.S. that specialize in providing Directors & Officers, Employment Practices, Fiduciary, Crime, Private Equity/Venture Capital and other customized insurance coverages for public, private and not-for-profit organizations. He led AXIS Insurance’s Commercial Management Solutions unit, formerly known as Financial Insurance Solutions (FIS), from April 2010 to May 2016. Previously, Ed had held Professional Lines home office and FIS regional management positions.
Preceding AXIS, he served as Senior Vice President and New York Regional Manager for Kemper Financial Insurance Solutions before that operation was acquired by AXIS through a renewal rights transaction in February of 2003. Ed was part of a core group that had worked together at Kemper FIS since 2000 when that operation was first established. He also previously held various underwriting and management positions within the New York Region of Chubb’s Executive Protection Department where he began his career.

He has handled hundreds of cases involving coverage issues related to cyber liability, professional liability, directors’ and officers’ liability, and errors and omissions liability. He is also an experienced litigator, handling cases in the areas of medical malpractice defense, defense of property management companies, and breach of contract, to name a few. Jeremy has participated in several complex insurance coverage and bad faith arbitration, as well as federal and state court trials and mediations. Jeremy has also briefed issues to the Seventh Circuit Court of appeals and presented oral argument to the Delaware Supreme Court. Ms. Schafle focuses her practice on the representation of entities that have suffered or may have suffered a data security event. When a potential data security event has occurred, Ms. Schafle assists clients in investigating and responding to the event. As part of this representation, she often works with law enforcement and independent forensic experts to identify the nature and scope of a data security event. Ms. Schafle works with clients directly to determine the impact of the incident on the client’s business; manner in which the potential intrusion occurred; identification of the individuals whose information may have been impacted; determination of the state, federal and foreign privacy laws governing the client's notification obligations arising from the incident; and preparation of legally compliant notifications to affected individuals, affected entities, and appropriate regulators. In addition to post-data privacy and network security event services, Ms. Schafle provides pre-data security event services, including document preservation, assessment of a company's forensic and legal vulnerabilities, and assessment and development of data privacy policies and procedures and Incident Response Plans. Ms. Schafle also provides industry-specific recommendations for proactive measures to address and mitigate risk. As part of her pre-data privacy and network security event services, Ms. Schafle also assists clients in developing and implementing in-house compliance and training programs.<br/><br/>
