The discussion will cover the future of DE&I policies, the implications of the Loper decision, and how the incoming administration might impact various facets of employment law, including immigration, changes in overtime thresholds, and captive audience meetings. This session will also provide updates on state-specific laws and minimum wage increases.

In our session we will explore AI in the Workplace; the current legal and regulatory frameworks; state laws and pending legislation; and international law and guidance. We will also discuss recent litigation; employer best practices; and AI and EPL underwriting exposures.

With nuclear and excessive verdicts in the EPL space becoming more “routine”, understanding what happens during jury deliberations is necessary to be able to adequately assess risk and develop strategy. In this mock-trial presentation, you will participate in a simulated trial as juror and get first-hand experience of how juries make decisions.

Although the United States is certainly well-known for its litigious culture, it is not the only site of Employment Practices Liability claim activity in the world. Employers everywhere confront workplace claims and litigation, that are made more challenging when there are conflicting rules, regulations, norms and standards among the jurisdictions in which they operate. There are multiple solutions for underwriting and insuring these exposures, and we will dive into some of the nuances between them. This presentation will explore the dynamic global EPL marketplace and its implications for all employers.

This presentation will analyze the current state of the W&H marketplace and exposure. It will provide insights into how the available coverage and capacity has evolved over time and what the prospects are for the product in the future. It will also provide insights as how the exposure has evolved in recent years looking, in particular at the evolution of the class/mass exposure in: (1) California, (2) at the federal level; and (3) the regularly evolving world of independent contractor classification both generally and in the gig economy space.
