D&O + Cyber Joint Session: The Intersection of Cyber and D&O-Bridging the Towers

The discussion will explore the gaps and overlaps in coverage between cyber and D&O policies through two claims scenarios – one a malicious attack on a large public company and the other a non-malicious outage of a public company’s computer network.  The panel will use the scenarios to illustrate the types of losses and claims that can arise and discuss which policies they trigger. We will also discuss best claims handling practice for the scenarios under both cyber and D&O policies, while highlighting potential areas of coverage gaps and overlaps. Next, we will address how to avoid the gaps in coverage, including how cyber risks impact the insurance procurement and underwriting process for cyber and D&O policies. The speakers will also discuss the differences in coverages available for private and public companies, as well as the differences in the risks presented to each. As part of that discussion, the panel will address the impact SEC guidance on cyber risks and incidents has had (and will continue to have) on companies and how it impacts cyber and D&O coverage. Finally, we will discuss the impact of AI technology and risks on cyber and D&O policies, as well as the other threats, issues and risks that appear to be on the horizon.
